1. Definitions

1.1 “Our”, “US” and “We” means Connection Import & Export Ltd.

1.2 “Customer” includes any user of our website.

1.3 “Contact Information” means information that would enable an individual to be contacted at a place of business and includes name, position name or title, business telephone number, business address, business email or business fact number (and which is not the subject of this policy or the PIPA).

1.4 “Personal Information” means information about an identifiable individual (such as the name, home address, phone number and e-mail address) but does not include contact information.

1.5 “Privacy Policy” means this document and any other policies that we may establish from time to time.

1.6 “Site” means our website at www.gm5.ca.

1.7 “You” and “your” means any customer.

2. Overview

2.1 We collect, use, disclose and dispose of personal information of our customers.

2.2 By providing us with personal information you accept the terms of the Privacy Policy and consent to permit us to collect, use, disclosure and disposal of your personal information in accordance with the terms and provisions of the Privacy Policy.

2.3 If you do not accept the terms and provisions of this Privacy Policy please do not provide us with any of your Personal Information.

2.4 The Privacy Policy sets out our policy and practices and our process to respond to complaints that may arise, pursuant to section 5 of BC Personal Information Protection Act (“PIPA”)

3. General Principles

3.1 We will inform our customers as to why and how we collect, use and disclose their personal information, and obtain our customers’ consent where required.

3.2 We will only collect, use or disclose our customers’ personal information in a manner that a reasonable person would consider appropriate in the circumstances.

3.3 We will protect personal information in our custody or control by making reasonable security arrangements to prevent the unauthorized access, collection, use, disclosure, copying, modification or disposal or similar risks. 

3.4 We will allow our customers to request access to and to request corrections to their personal information, and to provide, withhold and withdraw consent to the collection, use and disclosure of personal information.

3.5 We will designate a person to be responsible for ensuring that we comply with PIPA and outline a complaints process.

4. The Collection of Personal Information

4.1 Unless the purposes for collecting personal information are obvious, and our customer voluntarily provides his or her information for those purposes, we will advise our customer as to the purposes for which the personal information is being collected before we collect it.

4.2 We will collect customer information which is necessary to for purposes including the following:

a. To verify identity.

b. To conduct a credit check.

c. To verify customer preferences.

d. To open and manage a customer account.

e. To deliver products and / or services

f. To verify service delivery standards.

5. Provision of Consent

5.1 We will obtain customers’ consent to collect, use or disclose personal information (or where we are authorized to do so without consent).

5.2 Customers can provide oral or written consent to our collection, use or disclosure of personal information can be provided orally or in writing.

6. Implied Consent

6.1 Customers are deemed to consent to our collection, use or disclosure of personal information if, at the time the consent is deemed to be given, the purpose would be considered obvious to a reasonable person, and the customer voluntarily provides his or her personal information for that purpose.

7. Withholding / Withdrawing Consent

7.1 Customers may withhold or withdraw consent to use personal information.

7.2 A customer’s decision to withhold or withdraw his or her consent to use personal information may impact our ability to provide a good or service and, if so, we will attempt to explain the impact to the customer.

7.3 We may collect, use or disclose personal information without our customers’ knowledge in circumstances including the following:

a. Where it is permitted or required by law.

b. Where it is available from a public source. 

c. For the purpose of debt collection.

d. For the purpose of fraud protection.

8. Using and Disclosing Personal Information

8.1 We will only use or disclose customer personal information where necessary to fulfill the purposes identified at the time of collection.

8.2 We will not use or disclose a customer’s personal information for a purpose in addition to the purpose identified at the time of collection, unless we obtain consent to do so.

8.3 We will not sell customer lists or personal information to other parties unless we have consent to do so.

9. Retaining Personal Information

9.1 If we use personal information to make a decision that directly affects the customer, we will retain that personal information for at least one year so that the customer has a reasonable opportunity to request access to it.

9.2 We will retain customer personal information only as long as necessary to fulfill the purpose for which the personal information was collected or a legal or business purpose.

10. Making A Request To Correct Personal Information

10.1 We will make reasonable efforts to ensure that customer personal information is accurate and complete where it may be used to make a decision about the customer or disclosed to another organization.

10.2 A customer may request that we make a correction to their personal information in order to ensure its accuracy and completeness.

10.3 A request to correct personal information must be made in writing and provide sufficient detail to identify the personal information and the correction being sought.

10.4 If the personal information is demonstrated to be inaccurate or incomplete, we will:

a. correct the information as required; and

b. send the corrected information to any organization to which we disclosed the personal information during the year before the date the correction was made.

11. Securing / Destroying Personal Information

11.1 We are committed to ensuring the security of customer personal information in order to protect it from unauthorized access, collection, use, disclosure, copying, modification or disposal or similar risks.

11.2 The following security measures will be followed to ensure that customer personal information is appropriately protected:

a. Using user IDs and passwords for electronic files. 
b. Providing access to personal information on a “need to know” basis (i.e., only those that need to know will have access).

11.3 We will use appropriate security measures when destroying customer’s personal information such as shredding documents and deleting electronically stored information.

12. Making A Request For Access to Personal Information

12.1 A customer may request access to personal information under our control, information about the ways in which we have used personal information, and the manner (if any) in which the personal information has be disclosed.

12.2 A request to access personal information and / or the manner in which it has been disclosed must be made in writing and provide sufficient detail to identify the personal information being sought.

12.3 We will make the requested information available within 30 business days, or provide written notice of an extension where additional time is required to fulfill the request.

12.4 We may charge a nominal fee to a customer in order to cover the cost of responding to a request for access to personal information and / or for other information.

12.5 If we intend to charge a fee, we will inform the customer making the request of the fee, and ask the customer to confirm whether or not we should proceed with the request.

12.6 If we refuse to respond to a customer’s request to access information or for further information, we will provide a written response to the customer setting out:

a. the reasons for refusal; and

b. the customer’s recourse.
